“In partnership with Assist, we calculate and use values relative to the incentive of Presumed Credit of IPI (Tax on Industrialized Products), enabling the company to use said credit upon the offset of the IPI deriving from our sales transactions”

The scope of the work covered the calculation and use of the amounts related to the incentive of IPI Presumed Credit regulated by Law No. 9.363, of December 13, 1996, and the supervening legislation in the period comprehended between February 2006 and December 2010.

TThis is an incentive for companies producing and exporting domestic goods such as reimbursement of contributions to PIS (Social Integration Program) and to COFINS (Contribution for Social Security Financing) levying on the respective acquisitions, domestic market, raw materials, intermediate products and packaging material for using in the productive process.

Assist was responsible for separating and analyzing the documents, planning and ascertaining the revocable values. A report on the statement of the credit right based on legal grounds was submitted, thus avoiding exposing the client to any risks.

After a prior authorization of the company, Assist guided and followed up the procedures to use the credits.

The Tax Diagnosis was a quite complete project involving analyses of the tax books, trial balance-sheets and payrolls from the latest 5 years. Grupo Assist sought to identify opportunities of taking credits of ICMS (State Sales and Services), IPI (Industrialized Product Tax), PIS/PASEP (Civil Servants' Investment Program contributions), COFINS (Contribution for Social Security Financing), Social Security Contributions and Service Taxes of any nature that were not appropriate, deepening further analyses on possible undue payments or the majority of said taxes as well as identification of possible taxes aforementioned as well as identification of possible opportunities within the scope of the reductions in the tax charge.
In the first steps of existence of Assist the doors were opened in a company that would be later part of the group Akzo Nobel, for a partnership and expansion, on which occasion started to contemplate, in addition to the units of the group headquartered in the State of São Paulo, and others headquartered in Rio de Janeiro, Mato Grosso do Sul and Bahia.

It is a thirty (30) year partnership based on trust in the services that Assist has been providing -advisory and consultancy in the tax and social security areas, aiming at the adaptation, validation and optimization of the pertinent procedures.

Assist is responsible for the tax classifications of Tetra Pak since 2004. An internal department was created with Assist’s professionals who carry out an excellent work in identifying the NCM (Mercosur Common Nomenclature) and the corresponding tax burden, which can be evidenced in the result obtained in the Internal Control Audit–Blue Line.

The professionals working in the headquarters of Tetra Pak execute, with the support from a specialized team located at the Grupo Assist’s headquarters, procedures of technical analysis, tax description, tax classification (NCM), legal grounds, definition of tax burden and customs treatment of the materials.

In 2008, Tetra Pak was submitted to the Audit of Internal Control, provided for in Normative Ruling SRF No. 476/04, aiming at enabling the Blue Line Regime.

in support of the company, we carried out an extensive review of the database and arranged for changes in the procedures with the aim to reduce the divergences of the tax classification of goods and the goods and the tax burden. More than 15.000 materials were divided among the plants of Monte Mor and Ponta Grossa. Such regularization of the material base in relation to the tax classification enabled the company to obtain also an excellent result in a new Internal Control Audit carried out in the beginning of 2011. The audit company understood then to need adjustments of only 3% of a sample of 1.200 items selected for analysis that is 33 items.
“We contracted Grupo Assist to provide the services relative to the preparation of processes aiming at obtaining ex-tariff treatment for 4 products. The jobs also involved the activities of filing before MDIC (Ministry of Development, Industry and Foreign Trade) as well as the follow-up and clarification of doubts before the pertinent body. The result was very satisfactory once we were successful in all cases, without considering the special service submitted by the company’s professionals.”

The work developed for the partner aimed at rate reduction of the ad valorem import tax rates (II), pursuant to the Ex-Tariff condition. Assist was responsible for collecting and analyzing activities concerning technical information and supporting material to be attached to the records, according to the formal conditions required by the legislation in force.

It was also part of the object of the contract to prepare the lawsuits with the best technical description, which is essential for the success of the lawsuit once by means of such technical description the first arguments and differentials that justify the granting of a differential tax treatment are presented.

The claims at issue were fully approved by the Ministry of Industry, Foreign Trade and Services, resulting in a high added value to the partner once, in addition to the significant reduction of the tax burden referring the II (Import Tax), also allowed the registration of the respective products in BNDES (National Bank for Development) to access FINAME’s (Special Industrial Financing Agency of the BNDES) credit lines.

The partnership started in March 2011, on which occasion Dupont contracted the services of Tax Classification Review of about 13.170 goods. Technical visits were made in the client’s premises to analyze the goods and define the work plan.

The objective of the project executed for the company was to use the tax benefits of its “payroll exemption”, in accordance with Law No. 12.546/2011, which stated the social security contribution calculated on the gross revenue of the companies, aiming at reducing the tax burden of the beneficiary sectors.

The scope of the contracted Assist was quite broad, contemplating from the activities of elaboration of the calculation memories to the withdrawal and use of the values of opportunity to the preparation of DARFs for payment as required by law, rectification of the DCTF (Statement of Federal Tax Debits and Credits) and EFD (Digital Tax Bookeeping) Contributions, with the recording of the relative information in Block P (Determination of Social Security Contribution on Gross Revenue - CPR) as well as the SEFIP (Corporate System for FGTS Collection) rectification guidelines for the period from August 12 to December 13. Even after the the services are completed, Grupo Assist continued providing the whole support necessary for the company to consolidate the partnership with GEA Farm Technologies, which is one of the world leaders in providing solutions for the livestock.

The partnership between Bombardier and Assist was executed with the purpose of writing an opinion about the Incentive Program for Expansion and Modernization of the Railway Transport in the State of São Paulo, focusing on the tax treatment involving services and products furnished to the State of São Paulo.
